住宅装修工程施工合同管理问题与对策探讨 摘要 对住宅装修工程项目实施科学、合法、宜人的全过程合同管理是建立和谐的装修施工环境和防范相关纠纷发生的关键, 也是唯一和有效的手段。建立和谐的装修施工环境的途径主要有: 签订合同做到程序化、规范化、合法化, 严格执行合同及建立良好的合同关系等。本文首先界定住宅装修工程施工合同管理的科学内涵，揭示和概括阐述住宅装修工程施工合同管理的特色理论与原则，在此基础上，对住宅装修工程施工合同管理问题和容易发生的纠纷进行分类概述，进而多角度深层次剖析问题存在原因，并针对问题与原因，提出有理论和法律依据支撑、有可行性的一系列解决问题和防治纠纷的对策建议。希冀含有创新见解的本科研成果能对我国住宅装修工程施工活动规范化建设，形成住宅装修工程施工合同订立、履行、保修、索赔全程管理问题和纠纷的防治配套机制，更好地发挥科学的合同管理的有益作用有所裨益。 关键词 住宅；装修工程；合同管理；问题与纠纷；对策；防治机制 The Management of the Contract of the Decoration Work for Residential Construction and Its Countermeasures Abstract To establish a harmonious decoration and construction environment and to prevent some related disputes, it is a key point to carry out a scientific, legal and pleasant contract management during the whole process of the residential decoration projects. It’s also the only effective means. The main means for establishing a harmonious construction environment are: follow the procedure, standardization and legalization when sign the contract; enforce the contract strictly; form a good relationship for both sides. In this paper, first the scientific connotation of the contract management of decoration work for residential construction is defined, then its characteristic theories and principles are summarized to revealed. On this basis, some related problems and disputes are classified and outlined. And these problems will be analyzed from multi-points of views to find their causes, and certainly some countermeasures and proposals will be put forward. This research result with some innovative ideas is expected to play a useful role in our standardizing the construction activities of the residential decoration, forming a marching system to prevent the problems and disputes throughout the whole process of signing and carrying out a contract, as well as the warranty and claims, also bettering the contract management.
