XXXXXX管理学院 毕 业 论 文（设计） XXXX 届 法学 专业 XXXX 班级 题 目 论民事诉讼的诚信原则 姓 名 XXXX 学号 XXXXXXX 指导教师 XXXXX 职称 XXXX 二ОО 九 年 五 月 二十 日 内 容 摘 要 随着我国市场经济的建立和经济全球化法律一体化进程的加快，我国适时提出了依法治国和以德治国相结合的治国方略。而诚实信用在以民法为代表的私法领域已由道德原则上升为法律原则，并成为“帝王条款”。因此，若在民事诉讼中确立诚信原则，不仅对当事人的真实义务的规定，对法官的自由裁量的限制可以起到重要作用，还适应现阶段司法改革实践的需要。本文在阐述诚信原则的起源、内涵的基础上，分析了在民事诉讼中确立诚信原则的依据，并针对我国尚未在民事诉讼中确立此原则的状况，论述了在立法中确立诚信原则的建议。笔者提出了对法官、当事人及其他诉讼参与人违反诚信原则的惩罚办法，以期未来在我国民事诉讼中能够明确规定诚信原则，并有效发挥它在诉讼中、实践中的作用。 关键词 民事诉讼；诚信原则；利益均衡 Abstract With Chinas establishment of a market economy and the acceleration of economic globalization, and legal integration, we timely made the the strategy of governing the country that rule of law and virtue combining law. And good faith in civil law as represented by the ethical principles of the field of private law into legal principles and become the terms of the emperor. Therefore, if establish the principle of good faith in a civil action can not only play an important role in true of the obligations of the parties and the judges discretion restriction, but also adapt to the needs of practice at this stage of judicial reform. In this paper, with discussing the origin and connotation of the principle of good faith, and analysising the foundation of setting out the principle of good faith in the civil action, it shows that our country has not established this principle, and discussed the proposals for establishing the principle in legislation. The author proposed the penalty means to judge, the litigant and other lawsuits participates who offened the principle, hoping it can be clearly defined and effectively played in proceedings and in practice.
