本 科 毕 业 设 计（论文） 商业贿赂法律问题研究 Commercial Bribe Legal Matter Research 学 院（系）： 文法学院 专 业： 法学 学 生 姓 名： 学 号： 指 导 教 师（职称）： 评 阅 教 师： 完 成 日 期： 商业贿赂法律问题研究 法学专业　 ［摘　要］商业贿赂在我国的现象越来越严重，严重破坏着社会主义市场经济秩序，损害着人民群众的根本利益。本文从商业贿赂的概念和特征入手通过对商业贿赂存在领域和表现形式的分析，对商业贿赂做出一个相对科学的界定。第二部分对我国治理商业贿赂中存在的问题进行分析指出我国治理商业贿赂的必要性。第三部分借鉴英国及我国香港地区立法经验及成功实践对我国建立反商业贿赂体制起到借鉴作用，第四部分借鉴成功经验，进而对构建我国反商业贿赂的防治对策献言献策。 ［关键词］商业贿赂； 成因分析； 防治对策 Commercial Bribe Begal Matter Research Legal Science Specialty Abstract: The commercial bribe is getting more and more serious in our countrys phenomenon, is destroying the socialist market economy order seriously, is harming peoples fundamental interests. This article obtains from the commercial bribes concept and the characteristic through to the commercial bribe existence domain and the manifestation analysis, makes a relative science to the commercial bribe the limits. The second part governs the question which to our country in the commercial bribe exists to carry on the analysis to point out that our country governs the commercial bribe the necessity. The third part profits from British and our country Hong Kong area legislation experiences and succeeds the practice to establish the counter-commercial bribe system to our country to play profits from the role. The fourth part profits from the successful experience, then to constructs our country counter-commercial bribe the prevention countermeasure to offer the word to offer advice.
