连带保证中诉讼时效中断问题研究 摘要 《担保法解释》第三十六条第一款只规定了，连带保证中，主债务诉讼时效中断，保证债务诉讼时效不中断。该条款只规定了主债务诉讼时效中断，对保证债务诉讼时效的影响，并没有规定保证债务诉讼时效中断，对主债务诉讼时效的影响。笔者认为，既然《担保法解释》对此没有规定，应当转而适用《诉讼时效规定》的一般规定，对于连带债务人中的一人发生诉讼时效中断的事由，应当认定对其他连带债务人也发生诉讼时效中断的效力。并且根据民法原理，导致诉讼时效中断的事由，不仅仅包括对债务人本人的主张债权的行为，还包括对于债务人的代理人、财产代管人、从义务人（如保证人、抵押人等担保人）的主张，也是债权人主张债权的行为，同样会导致债权诉讼时效期间的中断。所以连带保证中，保证债务诉讼时效的中断，会导致主债务诉讼时效的中断。 关键词：连带保证； 主债权； 担保债权； 诉讼时效中断 Abstract Guarantee law?to explain?the first paragraph of article thirty-sixth?only provided,in the joint guarantee,?interrupt the main?debt?limitation of action,?guaranteed debt?limitation of action?without interruption.?The clause?provides only thelimitation?interrupt the main?debt,?debt?to ensure the?effect of?limitation of action,and no provisions?to ensure the?interruption of?limitation of action?effect of?debt,debt?of limitation of action.?The author thinks,?since?interpretation of the guarantee law?has not stipulated?shall?apply?the limitation of action,?toRegulations?provisions of?the?general,?for?one?joint debtors?occurs in theinterruption of the limitation of action?shall be deemed?grounds,?have the effect?of interruption of statute of limitations on?other joint debtors.?And according to theprinciple of civil law,?led to the?interruption of the limitation of action?causes,including not only?the?debtor I?assert a claim?behavior,?also includes?obligations for the?debtors?agent,?property custodian,?from?(such as a?guarantor,?the guarantor?mortgages?etc.)?claims,?is also?the creditors?claim?behavior,?will alsobreak period?lead to?claims?of limitation of action.?So?in the joint guarantee,guarantee the?interrupt?debt?of limitation of action,?will cause the?interruption?of limitation of action?of principal?debt.
