上海交通大学硕士学位论文CHARACTERIZINGANDREGULATINGTHELEGALFRAMEWORKOFBANK’SPERSONALFINANCIALPRODUCTSABSTRACTInrecentyears,thewealthmanagementbusinessofcommercialbankisdevelopingrapidly.Uptofirsthalfof2013,thebalanceofcommercialbank’sfinancialproductshasincreasedabouttwotrillionyuan.However,disregardingtheprofitsoffinancialproducts,thehugesystematicrisksofthesefinancialproductshaveemerged.ThefinancialproductofHuaxiaBanknamed‘Zhongding’andthefinancialproductofChinaConstructionBanknamed‘ZhengdaTaurus’havecausedthecashcrisisofthebanks.Thus,it’shightimetoidentifythelegalsystemofthecommercialbank’spersonalfinancialproductsandavoidtherisks.Firstofall,it’simportanttodefineandclassifythecommercialbank’spersonalfinanceproducts.Andthen,basedontheclassification,thelegalrelationshipofbank’spersonalfinancialproductsisconfirmed.Accordingtoempiricalanalysisofthedataaboutissuancequantityandinvestmentdirectionofbank’spersonalfinancialproducts,wecanfindthatcurrentmodeofoperationwillleadtolegalproblems,suchasthefundsofthefinancialproductscannotbeisolatedfrombankruptcy;‘fundingpool’operationmoderesultsinunequalrightsandobligationsofinvestors;custodianofcommercialbank’spersonalfinancialproductscannotplayaroleofsupervision;hastyrisktoleranceassessmentofinvestorsmaycauseIV上海交通大学硕士学位论文moralhazard.Therefore,methodsshouldbetakentoconquertheproblemsabove.Commercialbank’spersonalfinancialproductsshouldbeplacedunderthelegalframeworkoftrust.Furthermore,thesystemofindependentcustodian,accountingandqualifiedinvestorsmustbeestablished.KEYWORDS:commercialbank,personalfinancialproducts,independentcustodian,qualifiedinvestorsV上海交通大学硕士学位论文目录绪论..................................................................................................................................................1第一章商业银行非保本浮动收益型理财产品的概念界定.........................................................8第一节商业银行个人理财产品的概念界定.............................................................................8一、经济学领域对商业银行个人理财产品的理解................................
