AbstractProtectingthecopyrightoffilmandtelevisionscriptsisveryimportantforthedevelopmentoftheindustryoffilmandtelevisionandplaysapositiveroleinpromotingthespreadofculture.Butthecopyrightlawofourcountryonscriptsprotectionisnotclear.Thedisputesofscriptscopyrightusuallyarescriptplagiarism,newdisputationsoftherightofauthorship,writer’srightsonthesubsequentuseofworksetc.Butthecopyrightlawofourcountrycannotsolvetheseproblems.Tosolvetheseproblems,wehavetoresearchthecopyrightprotectionoffilmandtelevisionscripts.Thepaperstartsfromthecaseandelaboratesonthekeyproblemsappearedinpracticeandresearchesshortcomingsofthecopyrightlawofourcountryonscriptsprotection,thenputforwardcountermeasurestosolverelevantproblems.Inadditiontotheintroduction,thispaperisdividedintothreeparts.Therearemorethan20000words.Partone,casesummaryandtheprimarydisputes.Firstly,thepaperintroducesthecasesummary,thensummariesthemaincontroversies:thestandardofscriptplagiarism,thedisputationoftherightofthewriter’sauthorship,writer’srightsonthesubsequentuseofworks.Thecopyrightlawofourcountrydonotruleonthestandardofscriptplagiarism,onlyregardsitasabehaviorofcopyrightinfringement.ThePeople’sRepublicofChinaCopyrightLawcannotsolvethenewdisputationsontherightofthewriter’sauthorship,suchashowtoexpressthewriter’srightofauthorship,inwhichposition,inwhichmethod,inwhatorder.Thelawontherelationshipbetweenthewriterandthefilmandtelevisionworkisnotclear,soinpractice,wedonotknowiftheproducesshouldgettheconsentofthewriterforthesubsequentuseoftheworks,suchastheworkadaptation,thenoveldistributionetc.Parttwo,legallyanalysisofthedisputations.Thispartmainlyanalysesthreemainquestions:firstly,thedistinguishingstandardofplagiarism.Theacademiccirclesdon’thaveastandardontheplagiarismdistinguishing,themainstandardsarefollowing:timejudgmentrule,comparisonjudgmentrule,researchjudgmentrule,degreejudgmentruleetc.Inpractice,therearethreestandards,thatis“contactplussubstantialsimilaritystandard”and“originalitystandard”and“threestepsjudgmentstandard
