AbstractIn the rule of law society, people will consider more way to solve the disputes through litigation, to protect their legitimate rights and interests, but as afterwards relief way, the period of litigation activity is sometimes so long that after the judgment or ruling reach, the victims damage has been made up for hard and the result of the judgment or ruling is sometimes difficult to achieve, which is unfavorable for the judicial activities .In order to avoid the above results and in a timely manner to protect the lawful rights and interests of the parties and ensure the smooth implementation of the decision ,the preservation system was increased at the historic moment. In the early years ,the civil procedure law in our country hasstipulated property preservation system，which has not completely to meet the needs ofpeoples justice, because not all the disputes involve property and sometimes the judgment or ruling requires to limit certain actions ,finally the act preservation system was established in the new civil procedure law of 2013 in our country .Act preservation system being written in the law makes up for the existing system of property preservation and advance execution system and complete the civil preservation system in our country ,which is a great progress of legislation. But each kind of new system that is written in the law exists some disadvantages. This article has its own point of view about the establishment of the act preservation system in our country and the perfect measures of the act preservation system.In the perspective of the preliminary temporary injunction case of the epistolary manuscript of Qian Zhongshu , this article advances some questions. Around these problems, this article defines the connotation of definition of act preservation as the breakthrough point and basis on relevant systems of two law systems to analysis emphatically the provisions of act preservation in the new civil procedure law of 2013 and put forward its o
