分从分析美国、欧盟和日本的相关制度经验入手，提出适合我国相关制度借鉴的若干启示。第四部分，结合我国目前汽车产品召回法律制度运行的实际情况提出若干完善建议。本部分提出的建议包括：升级立法位阶，明确缺陷认定标准，明确政府职能以加强监管，建立独立、中立的专业缺陷鉴定机构，完善相关法律责任形式。关键词：汽车产品召回；缺陷认定；责任形式；法治建设AbstractWiththeconsumptionandqualityproblemofautomotiveproductsisbeingpaidmoreandmoreattention,thevalueofthelawsystemofrecallingautomotiveproducthasbecomeincreasinglyprominent.Inpractice,recallingautomotiveproductishelpfulineliminatingthedamagewhichthedefectiveautomotiveproductcouldcausetosocietyandtheother?sbodyandpropertymaximizebeforeithappened,andatthesametime,italsoreflectsthehighdegreeofrespectforthepersonalandpropertysafety,andtheentiresocietyofthecarproductoperators.ChinaautomobileproductrecalllegalsystemimplementedformallyaftertheCarEefectiveProductsRecallManagementRegulationsenactedin2004；thereafter,theissueofOntheImplementationoftheRecallManagementDefectsontheVehicleM2andM3ClassBulletin(2006twenty-third)andOntheImplementationoftheRecallManagementBulletinontheNClassandOClassVehicles(Twenty-Fourth2009)andsomeothersystemrefinedtherangeofvehiclesforvehicleproductrecall,promotedthedevelopmentofthewholeautomobileproductrecalllawsystem.InJanuary1,2013,theimplementationofEefectiveAutomobileProductRecallManagementRegulationspromotedthedevelopmentofautomobileproductrecalllawsystemfurthermore.Atthesametime,itshouldbenotedthatChinasautomobileproductrecalllegalsystemisstillnotperfect,thesystemstillexistsaseriesofproblemswhichincludethatlegallevelisnothigh,thestandardoftherecognizingdefectsforautomotiveproductisnotclear,thelackofexperienceofjuridicalpracticeandsoon,theseproblemsleadautomotiveproductsinChinatofacemanydifficultiesintherecall,therefore,strengtheningtheresearchofthelegalsystemforautomotiveproductrecallhasveryimportantpracticalsignificance.Thecontentofthispaperconsistsofthefollowingaspects:Thepartofintroduction,accordingtotheFAWVolkswagenSagitarrecall,leadstheproblemandthesignificanceoftheresearchoftheautomobileproductrecalllawsysteminourcountry;putforwardtheresearchmethodofthestudycontent,a
