摘要当代中国，随着市场经济的飞速发展、民主政治的日益完善，公民的民主意 识和参政意识不断增强，特别是公民要求保护自己知情权的愿望越来越强烈，政 府信息公开成为世界潮流。我国 2008 年颁布的《中华人民共和国政府信息公开条例》至今已经实施 6 周年，法规实施虽然取得了一定的成效，但是立法和实践过程中也出现了很多问题：《政府信息公开条例》关于范围的规定过于笼统、抽象， 缺乏可操作性；《政府信息公开条例》立法等级过低，并与《保密法》、《档案法》 等相关法律、法规存在冲突、不一致的地方；依申请的政府信息公开的比例过低， 民众的知情权得不到有效的保护；国家秘密、“三安全、一稳定”经常被当作拒绝 公开的万能挡箭牌，政府信息不公开的范围看似很小实质上很大。此种背景下， 深入研析中国政府信息公开制度特别是作为其核心问题的政府信息公开范围问题 具有十分重要的理论价值和现实意义。政府信息不公开范围问题是建立在保护公 民知情权的立法目的以及“以公开为原则，不公开为例外”的基本原则之上的， 并应当运用立法否定列举的规定方式，目的是框定和明确政府信息不公开的范围， 使政府信息公开范围清晰明确，避免实践中出现行政机关以模糊的、不可知的理 由拒绝公开政府信息，侵害公民的知情权。本文综合运用比较研究、案例研究、 文献研究等方法，从立法和实践两个方面分析我国政府信息不公开范围的现状及 存在的问题，总结问题产生的原因，并在文章最后一章提出一些完善建议。本文 的主要成果是科学厘定我国政府信息公开制度的立法目的、基本原则、不公开范 围的规定方式，并在最后提出应就《政府信息公开条例》所规定的不公开的事项 进行增删，增加列举意见性的过程信息、纯粹的内部信息、有危害的执法类信息， 删除“三安全、一稳定”的概括规定，并对国家秘密、商业秘密、个人隐私的不 公开情形进行条件限制和类型划分，进一步强调兜底条款必须符合“以公开为原 则，不公开为例外”的基本原则。 关键词：政府信息公开，政府信息不公开，知情权IABSTRACTNowadays, with the rapid development of the market economy, increasingly perfect democracy, growing awareness of democratic and political participation of citizens, especially the desire of citizens to demand to protect their own the right to know is more and more intense, the government information disclosure has been a global trend.
