AbstractIntheruralofourcountryhasfacedwithalong-termfinancingproblems,andthatisbecausethefarmerlacksthenecessarycollateral.Inordertosolvethisproblem,Ningxia,Wuhan,Chongqingandotherplaceshavecarriedoutthemortgageloanpilotoftherighttooperatecontractedland,complywiththeimplementationoftherightstooperatecontractedrurallandreasonableusetrends,andachievedgoodresults.Atthesametime,thepilothasalsoexposedsomeproblems,intheblockupthesystempromotiononcertainlevel.Practicehasprovedthat,themortgageoftherightofcontractedlandisplayswithanimportantroleinremittingthefinancingproblemsintheruralarea,stimulatingagricultureindustrializationandprosperityoftheruralfinancialmarket.Thus,bysummarizingtheworthtodrawlessonsfromthecurrentpilot,foundtheproblemsandputsforwardthecorrespondingcountermeasure,realizetopromotesmoothofthemortgageloanoftherighttooperatecontractedlanditisverynecessary.Thispaperisdividedintothreeparts:thefirstpart,thegeneralquestionofthemortgageloanoftherighttooperatecontractedland.Mainlydiscussforthemortgageloanoftherighttooperatecontractedlandbasicproblems,andtheanalysisofitstheoreticalbasisandtherealisticdifficultiesandthepracticalsignificanceofthemortgageloanofrighttooperatecontractedland.Thesecondpart,thecurrentsituationsandexistingproblemsinmortgageloanoftherighttooperatecontractedlandinourcountry.ThepartbasefromtheintroductionthesituationofthemortgageloanoftherighttooperatecontractedlandintheNingxiaHuiAutonomousRegion,LiaoningProvince,Wuhancityandotherplaces,andsummeduptheworthtodrawlessonsfromthecurrentpilot,suchasenactednormativedocuments,takeavarietyofuniquemodelstopromotethemortgageloanoftherighttooperatecontractedland.Atthesametime,wecanalsofoundsomeproblemsfromthepilot.Mainlyasaccordingtothecurrentlawofourcountry,mortgageofrighttooperatecontractedlandisforbidden;lackofmortgageregistrationsysteminthemortgageofrighttooperatecontractedland;unreasonablepricemechanismandthefinancialinstitutionstoimplementmortgageexistenceobstacleandfortheseproblemsareanalyzedindet
