AbstractIn 2008, the financial turmoil intrigued a global economic crisis. Enterprises around the world faced the threats of declined profits and breakdown. In order to lower costs, many companies adopted the method of economic layoff. Economic layoff is not only closely related to internal business management of enterprises, but also has much to do with the legal system. Economy layoff can affluence a large quantity of people and has a great social influence—such as the employee’s right of subsistence. Laws related to this activity are rigid, especially in developed countries, to prevent improper layoffs. Compared to western countries, China’s market economy is underdeveloped and has a weak legal system in terms of economic layoff. The problems created when Chinese enterprises perform economic layoffs initiate labor disputes. It’s is vitally important to make a thorough analysis of the economic layoff practices in China, explore proper ways to do it, and maintain mutual benefits among enterprises, employees and the whole society.Based on an analysis of the existing problems in the practice of economic layoff by Chinese enterprises from the perspective of human resource and legal system, the current thesis probed into the main reasons of the problems, made a comparison with the regulation of economic layoff by western developed countries and put forward the suggestion that Chinese enterprises should have their economic layoff regulated to prevent relevant risks.This ultimately concluded that layoffs must be scientific and rational way: the need for layoffs as a rational measure, select objects layoffs, layoffs standard, layoffs means to improve staff performance appraisal system. Layoffs have to be the premise to comply with state law, must not be a rational cost analysis has not been that for illegal layoffs, layoffs, such as to comply with statutory requirements, the number and time elements, the economic compensation.
