沉船沉物强制打捞费用保障法律机制研究.docVIP

摘 要 沉船沉物强制打捞相关问题在过去的几十年中一直没有得到国际以及世界各国的重视，这恐怕与过去的沉船事故不能造成很严重的后果有关，并且也没有明确的国际公约来规定沉船沉物强制打捞各方的权利和义务，但随着船舶沉没事故对航运安全和环境造成越来越多严重的影响以及《残骸清除公约（草案）》的问世，世界各国已经掀起了一股对沉船沉物强制打捞相关法律问题讨论的热潮，有关强制打捞的立法也成为了国际上海事立法的新趋势。 目前，国内外有关沉船沉物强制打捞问题的研究广泛，其中包括研究责任主体、费用的性质、各方的权利义务关系，其中关键是沉船沉物强制打捞费用如何实现的问题，当前有关该问题的研究主要体现在以下几个方向：沉船沉物强制打捞费用的性质、沉船沉物强制打捞费用的责任主体以及如何构建沉船沉物强制打捞费用实现的保障机制等。这些研究虽然都取得了一定的成果，但并与当前最新的国际公约相结合，也不符合当前海事立法的新趋势。而本论文通过查阅相关资料以及国内国外最新的有关沉船沉物强制打捞费用实现的立法情况，结合最新的国际公约，综合了过去各方面的强制打捞费用实现的各方面研究，并提出了两种目前符合海事立法趋势的强制打捞费用保障机制，给强制打捞费用的实现提供了一套可行的法律机制。 本文的主要内容分为以下几个部分： 第一章：沉船沉物强制打捞概述。主要讨论了沉船沉物强制打捞的相关概念的定义和范围以及国内国外有关沉船沉物强制打捞的立法。 第二章：沉船沉物强制打捞费用的法律性质。主要讨论了沉船沉物强制打捞的三种法律属性以及与属性挂钩的强制打捞费用的性质。 第三章：当今沉船沉物强制打捞费用实现的现状及其困境。主要讨论了当前沉船沉物强制打捞费用实现的现状以及面临的问题。 第四章：构建沉船沉物强制打捞费用保障的法律机制之一——建立沉船沉物强制打捞强制保险制度。主要讨论了建立沉船沉物强制打捞强制保险制度的必要性、如何实施强制保险制度以及强制打捞强制保险实行的利弊。 第五章：构建沉船沉物强制打捞费用保障的法律机制之一——设立沉船沉物强制打捞基金。主要讨论了强制打捞基金费用的征收和管理以及强制打捞费用基金的实施。 关键词：沉船沉物打捞，费用保障，强制保险，基金 ABSTRACT The related problems of compulsory salvage of sunken ships had not been caught so much attention by every countries in the world in the past a few decades, which could be resulted in the unserious consequences of the accident of the sunken ships. And there were not definite international covenants to regulate the rights and obligations of each part of compulsory salvage of sunken ships. But with the serious influences to the safety of navigate and environment which were caused by the accidents of the sunken ship and also because of the appearance of the Draft　Convention on Wreck Removal , world has aroused a boom discussion of problems of compulsory salvage of sunken ships and relevant legal issues. Through the writing process of this paper, the author made a deep research of the expenditure of guarantee mechanism of compulsory salvage.
