物权法的视野：农村坟地的法律保护 摘 要：近年来，农村坟地纠纷的案件不断增多，引起了社会各界得广泛关注。由于我国尚未对农村坟地问题作出专门的立法规定，在发生坟地侵权案件时，经常在坟地权属确认、责任承担等方面发生严重分歧。这对于依法保护坟地使用者的合法权益、惩治违法行为人等都产生了不良影响。本文主要从物权法的角度，并结合其他的法律法规，探讨农村坟地的法律保护问题，对坟地所有权、使用权、相邻关系、收益、地役权、抵押权等问题作了初步探讨，以期对涉及坟地问题的立法和司法完善有所裨益。 关键词：坟地；权属；损害赔偿 Abstract：In recent years, the rural cemetery increasing cases of disputes, have caused widespread concern in the community. Due to the rural cemetery in China has yet to issue specific legislative provisions, in the event of infringement cases graves and often in the cemetery to confirm ownership, responsibility and so serious differences. This is in accordance with the law to protect the legitimate rights and interests of users of the cemetery, to punish all violations of people have a negative impact.
