摘 要慈善事业不仅在我国社会救济领域承担重要角色，也是社会保障体系的重要组 成部分。慈善事业发展的核心是如何合理筹集和分配慈善资金，但是我国慈善资金 在运作过程中出现了资金收入结构不合理，社会融资能力差，慈善组织信息公开制 度缺位，善款管理缺乏法律责任机制，资金发放欠缺有效的追踪问效制度，等等一 系列问题。因此，在慈善资金的监管方面寻求法律制度上的约束显得尤为重要。本 文从慈善资金的基本理论入手，以慈善资金在运营过程中所出现的各种问题为研究 出发点，并在借鉴国际先进经验的基础上，结合我国国情对我国慈善资金的监管法 律制度的进一步完善提出了自己的建议。本文共分为四部分： 第一章慈善资金监管概述。对慈善资金的相关概念和慈善资金运作流程各阶段的监管意义进行了基础性概述。 第二章我国慈善资金监管存在的法律问题。在对我国慈善事业立法概括介绍和评析的基础上，重点论述我国慈善资金监管方面存在若干法律问题，按照慈善资金 运行的募集、管理、使用流程顺序具体展开分析。第三章国外慈善资金监管制度分析和启示。分别介绍了美国、英国和新加坡的 慈善资金监管制度，并通过分析总结得出对我国的启示。第四章完善我国慈善资金监管法律制度的建议。首先，针对我国现有慈善事业 立法的不足，提出了完善相关立法的总体框架构想，主要观点是：尽快出台我国《慈 善事业促进法》；扩大行政法规的适用范围，变革相关法律的配套和补充规定；重视 地方性慈善法规、规章的施行和完善。然后，针对慈善资金运作过程中出现的具体 问题，借鉴国外经验并结合我国国情，提出了完善慈善资金监管的具体法律制度的 若干建议，主要观点包括：合理引导调整善款的收入结构，拓宽慈善资金来源的途 径；完善慈善捐赠的税收减免法律制度，增加慈善资金积累；“内外合力”积极建立 信息公开制度，提高我国慈善组织的社会公信力；建立健全慈善资金财务管理与监 督制度，堵住资金使用漏洞；完善慈善组织内部管理责任机制，盘活慈善资金；规IIIII范慈善组织内部行政开支，实行定员和定额管理；合理规划项目及活动支出，实现对资金流向的有效监管；建立慈善资金使用追踪问效法律机制，保障资金利用的高 效益。关键词：慈善资金；慈善资金监管；法律制度IIIIIIAbstractCharity is not only making an important role in the social relief of our country, but also an important part in the social security system. The core of the development of the charity is how to raise money and how to allocate funds; but in the processes of operation, the charity fund in China occurs a series of questions such as “unreasonable incomestructure”、“poor raising ability”、“the lack of charity information disclosure system”、“thelack of legal accountability in money management”、“the lack of effective efficiency checking in the use of funds” and so on. Therefore, it is particularly important to seek legal control in the charitable funds regulation. So, this thesis starts from the basic theory of charity, and makes the various problems in the charity operation as the major points ofresearch. And in reference to international advanced experience, this paper will combine the national conditions and give own suggestions on how to further improve our charity legal institution.There are four parts in this paper:The first chapter shows the outline
