行政调查论文：行政调查中相对人权利保障问题研究【中文摘要】2009年的上海“钓鱼执法”事件引发了人们对行政调查中相对人权利保障的关注。行政调查中的相对人是指在行政调查活动中,行政调查行为所指向的在行政法上承受权利义务的公民、法人或者其他组织。由于行政调查是行政主体进行行政管理活动所必须依赖的行为,因此,行政调查活动伴随着行政权的扩张而广泛存在与人们的生活中。由于学术界一直没有对行政调查的重要地位给予足够的重视,因此对于行政调查中相对人权利的保障也处于一个尴尬的地位。本文通过以权利本位的法学观念和行政调查制度本身来明晰行政调查中相对人权利的合理性,进而探讨行政调查中相对人的各种权利,分析对行政调查相对人权利保障的必要性。上海的“钓鱼执法”仅仅是行政调查中相对人权利受损的冰山一角。在行政调查中,由于行政调查方式的不同,对于调查相对人有不同的损害。行政调查中相对人权利受损的原因主要有相对人维权意识薄弱、法律规范和相关制度缺失等。因此,对于行政调查中相对人权利保障机制的完善可以从三个方面进行。首先要完善行政调查中相对人权利保障方面的法律法规；其次可以从实体法和程序法方面对行政调查制度进行相应规制；最后完善行政调查中相对人的权利救济途径。文章主要分为五个部分。第一部分是引言。第二部分主要是行政调查中相对人权利的基本理论。包括权利存在的合理性,权利的主要内容以及对权力进行保障的必要性。第三部分主要对行政调查中相对人权利现状及原因进行分析。揭示不同的行政调查方式对相对人权益造成的不同损害,并探讨其形成原因。第四部分主要探讨如何完善行政调查中相对人权利保障机制。本文认为可以从三个方面进行完善,一是加强权利保障的立法工作,二是从实体和程序两个方面对行政调查进行规制,三是完善行政调查中相对人权利救济的途径。第五部分是本文的结论。通过对整篇文章总览式的梳理,对行政调查相对人权利救济的立法途径进行展望,以期通过《行政诉讼法》的修改和《行政程序法》的制定达到人权保障的终极。【英文摘要】2009 Shanghai “entrapment” incident has caused a concern of protection human rights in the administrative investigation.
