石家庄铁道大学学年论文 国际工程承包中的索赔问题研究 The research of claim in international engineering contract 2008届 经济管理 学院 专 业 国际经济与贸易 学 号 学生姓名 指导教师 完成日期 2011年 08月 20日 摘 要 在执行国际承包工程的过程中，往往会因为大到国际形势的变化、小到工程所在国家或地区以及施工区域甚或工程项目本身的设计不足乃至缺陷等不同因素的变化，给工程项目带来变异，从而导致承包商费用的加大、设备数量增加、材料消耗加重、工期延长等不利于承包商的结果。由于这些因素都是外部环境造成的，与承包商的主观意志相违背，且不是承包商的故意责任所致，所以承包商可以据理依法获得相应的补偿。这是国际承包工程运作中常常遇到的而又必须认真对待的一个实际问题。本文介绍了国际工程的基本情况及进行国际项目规范化合同管理的FIDIC（菲迪克）合同条款，分析了国际工程项目索赔发生的原因以及进行索赔所需要的主要依据，并以FIDIC（菲迪克）索赔条款的选择为例，提出了如何选择适当的索赔条款，来进行国际承包工程项目的索赔。 　　关键词：国际承包工程 索赔 FIDIC（菲迪克）合同 　　 Abstract During the execution of international contract project, often because small changes in the international situation, to work country or region, and the construction of regional or even different factors such as inadequate and even the flawed design of the project itself changes, bring variation to the project, thus leading to contractor costs increase, increase in the number of devices, material consumption increased, duration, extension and so detrimental to the results of the contractor. Because of these factors is caused by the external environment, and is contrary to the subjective will of the contractor, and is not caused by intentional responsibility of the contractor, so contractors can be argued to appropriate compensation in accordance with law. This is often encountered in the course of international contract engineering and is a real problem that must be taken seriously. This article introduced the basic situation and international projects of FIDIC Contracts for the international standardization of project management (FIDIC) contract terms, analysis of international engineering project claims the cause as well as the main basis for claim is required and FIDIC (FIDIC) claim terms of select, for example, made claims on how to select the appropriate terms, to claims for international contracted project. 改革开放二十多
