非婚同居期间财产关系研究 摘要 伴随着自由精神的演化，非婚同居在我国也逐渐盛行起来，很多男女在进入婚姻前将会选择同居“适婚”，当此类事件逐渐增多，也产生了相应的问题。当双方感情破裂，同居关系难以维系，在双方共同生活期间，所涉及到的钱财将如何处理成为主要纠纷，各类案件也不断增多。在法律层面而言，虽然双方处于共同生活状态，但是双方的社会属性在法律层面并未发生变化，仍然属于双方独立的个体，因此，双方的个人财产将会受到保护，也就是甚多收益或者债务等仍然需要界定其去向。 在此次研究中，研究的主要课题便是非婚同居的财产关系，在研究中，引入案例，分析其中主要分歧点，并且根据对案例的分析展开非婚同居的探讨，了解非婚同居的定义，并且了解我国当前法律条款中所存在不足，在提出建议之前，了解外国的经验引为借鉴，提出完善我国法律的建议，望带来借鉴。 关键词；非婚同居；财产关系；分歧研究  abstract Along with the evolution of free spirit, unmarried cohabitation in our country has gradually flourished, many men and women in marriage will choose cohabitation marriage, when such events gradually increased, also produced the corresponding problems. When the relationship between the two sides broke up, living together is difficult to maintain, in the common life of both sides, the money involved will be how to deal with a major dispute, all kinds of cases are also increasing. At the legal level, although the two sides in the common life, but the social attributes of both in the legal level did not change, still belong to two independent individuals, therefore, the two sides of the personal property will be protected, is also much income or debt still need to define their whereabouts. In this study, the main topic is the study of the non marital cohabitation relationship, in the introduction of case study, and analysis the main points of disagreement, and according to the analysis of the case of unmarried cohabitation, understand the definition of unmarried cohabitation, and understand Chinas current law in the problems, and put forward some suggestions on before, learn foreign experience for reference, put forward to perfect our legal advice, hope to bring some reference.
