我国旅游消费者权益法律保护问题研究 摘要 旅游消费者权益是指旅游消费者基于法律规定或合同约定而享有的做出一定行为或不做出一定行为,要求旅游经营者做出一定行为或不做出一定行为的权利,及权利行使所带来之利益,其中权益主要分为一般权益和特殊权益。以美国、日本和泰国等为例介绍国外优秀旅游立法经验。介绍当前我国对旅游消费者权益保护的立法概况,包过相关法律,行政规章和行政法规和相关司法解释。目前,我国对旅游消费者权益的法律保护存在以下缺陷:我国对旅游消费者权益保护的规范机制缺陷;其救济机制不足;其监督机制失调。从问题看出路,可以对应从以下几方面进行完善:修补合同法、旅游法和专项法;完善旅游纠纷处理制度和精神赔偿制度;完善立法监督、行政监督和社会监督。 关键词:旅游消费者;权益;价值分析;立法缺陷;完善建议 Research on the legal protection of tourism consumers rights and interests in China Abstract Tourism consumer rights and interests is to point to consumers based on law or contract, have a certain behavior or not a certain behavior and require tour operators to make certain behavior or not a certain behavior of right and right of exercise brings benefit. These rights are divided into general rights and special rights. The United States, Japan and Thailand are as examples to introduce excellent tourism legislative experience abroad. At present, the current situation of the legislation of tourism consumer rights protection in China is introduced, including the relevant laws, administrative statutes,administrative regulations and related judicial interpretations. Now, there are some defects in legal protection of rights and interests of tourism consumers in China: our country to protect the interests of consumers of tourism regulation mechanism defects, the relief mechanism and our supervision mechanism. Way from the problem, correspond from the following aspects to improve: repair contract law, tourism law and special law; improve the tourism disputes handling system and the system of mental compensation; improve the legislative supervision, administrative supervision and social supervision.
