PAGE PAGE 28 南 京 师 范 大 学 毕 业 设 计（论 文） （ 2009 届） 题 目： 通过业主公约的城市小区治理 ——软法之治的生活视角 学 院： 法学院 专 业： 法 学 姓 名： 孙 权 学 号： 指导教师： 庞 正 教授 南京师范大学教务处 制 通过业主公约的城市小区治理 ——软法之治的生活视角 内容摘要：软法是通过平等主体共同参与、经由协商程序制定并共同保障实施的成文性行为规范，是一种产生于私域而指向公共领域的非典型意义上的法。通过软法之治的生活视角可以发现，业主公约正是这样一种具有基层群众自治组织的自治规范性质的软法。理论上，业主公约本质上是对社会经济发展产生的法权要求的具体反映，在内容上具有地方性知识和自生自发秩序的基本属性，在形式上具有通过程序的正当性。实践中，它被西方许多国家和我国台湾地区的立法所采纳。面对我国现实中住宅小区内相关主体错位、业主意识不健全等现状导致的小区内矛盾突出、治理困难重重的困境，作为软法的业主公约符合通过最小的干预和最适宜的规范要求，能够为小区业主们提供更多的营造优质生活的机会和条件，具有卓越的小区治理功能，并有利于社会孕生出民主、自治的现代法治精神。 关键词：业主公约 软法 小区治理 软法之治 Abstract: Soft law is the written code of conduct that is legislated and implemented through the procedure of joint participation and equal consultation among equal subjects. It is an atypical law which arose from the private domain while points to the owners’ pact is exactly such kind of regulation characterized by self-organization and self-government of the grass-root level. In theory, owners’ pact is essentially a concrete reflection of the request of socio-economic development, its content possesses the basic attributes of local self-knowledge and spontaneous order and it is legitimate in form owing to its adoption of formal procedures. In practice, it is also adopted by the legislature of many western countries as well as Taiwan province. In the problem of sharp contradiction and governance difficulties caused by the realities of related principals’ dislocation, unsoundness of the owners’ awareness and so on in china, as a kind of soft law, owners’ pact that is in the line with the minimized intervention and the most appropriate regulatory requirements can provide more chances and conditions to create life of high quality, and boast the excellent function in the governance of community, which will intensify the generation of a de
