我国实行改革开放以来，外资对我国社会主义市场经济建设起到 了极大的促进作用。外资的进入为我国市场带来了雄厚的资金、先进 的技术和高效的管理经验的同时，为了谋取更多的利润，它们利用资 金、技术等优势通过并购我国的中小企业来达到其控制甚至垄断的市 场地位。外资并购对我国企业来说有利有弊，它能最大的促进我国企 业的发展，可是也会造成市场份额的过度集中，导致垄断的形成。而 且我国外资并购反垄断法律的规制也存在一些问题，因此本文在分析 探讨外资并购的反垄断规制的同时并提出一些建议。 关键词外资并购相关市场认定立法现状 Summary Since China adopted the reform and opening-up policy, foreign investors has played a great role in China’s socialist market economy. To reap more profits and to achieve their control or monopoly market position, local small and medium enterprises are acquired by their competition advantages, at the same time they bring abundant cap
