PAGE 14 第 页（共10页） 施工索赔对工程造价的影响及解决方法 重庆工商大学 2005级工程管理二班 贺君陈 指导教师：田双全 摘要:施工索赔是指在建设工程施工过程中合同一方不履行或是没有全面履行合同所设定的义务而遭受损失时，向对方所提出的赔偿要求。在建设项目管理过程中，施工阶段是项目投资额最大、管理最复杂，是能否实现项目管理目标的关键环节，业主如何做好施工阶段的索赔预防和处理工作将直接关系到工程项目管理目标的实现。为了保证建设工程能够达到业主预期的目标，业主需要通过对可能发生的赔偿事件原因进行分析，坚持以预防为主，在工程项目实施的全过程，对索赔事件采取防范措施和管理。本文从施工索赔的成因出发，立足工程项目的各个阶段，分析、控制与解决施工索赔，以便更好的控制工程造价。 关键词：业主 施工索赔 索赔原因 索赔预防 索赔处理 Abstract：Claim construction is defined as the process of construction works contract one party does not perform or did not fully implement the obligations set by the contract and when they suffer losses to the other claims made by, In the course of construction project management, construction phase of the project the largest amount of investment, management, the most complex, can achieve the goal of project management the key to the owner how to do a good job in the construction phase of the prevention and management of claims will be directly related to the objectives of project management to achieve. Key words：Proprietor Claim construction Claim Cause Claims Preventing Claims Processing 引言 随着我国对外开放进程的加快，涉外工程也越来越多，我国的建筑市场正从传统的计划经济走向开放的市场经济，并逐步与国际接轨。建筑产品价格的确定方式从以前的预算价格转向以招标投标方式确定价格，结算方式也从以前的施工图预算加签证的方式转变为合同价加索赔款的方式，索赔问题也因此受到广泛的关注。由于HYPERLINK /dangdai/现代建设工程投资建设规模较大、技术含量不断提高、差异性大、综合性强、风险大、投资额度大、建设周期长、设备材料型号规格多、价格变化快，而工程合同不可能对整个施工期间可能出现的情况作出完整的预见和约定，所以施工索赔成为必然。工程建设的各个阶段，都有可能发生索赔，尤其是施工阶段的索赔发生较多，索赔基本上贯穿工程项目施工的全过程。索赔通常都是和金钱相挂钩的，一旦发生了工程的索赔，那么势必对工程的造价造成一定程度的影响。相关资料显示索赔问题所引起的工程结算的上升
