安置輔導執行的因應策略-從社工與司法的觀點出發 101 安置輔導執行的因應策略 ─從社工與司法的觀點出發 李自強 臺灣台中地方法院 少年保護官 摘要 對於觸法少年的司法處遇可分成機構處遇 、社區處遇兩大類型。機構處遇 係以隔離、監禁達成嚇阻與矯治之目的；社區處遇則是以運用去機構化及非監禁 式個別化處遇計畫，藉輔導與治療達成復健的積極目的。台灣對觸法少年的司法 處遇是以少年事件處理法為基礎，受復健模式取代懲罰作法思潮的影響，民國八 十六年十月少年事件處理法的第五次修正，其中第四十二條安置輔導即係將具復 健理念的社區處遇作法導入對觸法少年的司法處置。 本文針對台灣地區各地方法院的少年司法工作人員（N=140 ）與目前正在執 行安置輔導的機構工作人員（ N=109 ）為研究對象，採自編問卷進行問卷調查， 並運用次數分配、t-檢定進行資料處理，以了解安置輔導執行現況看法與因應策 略意見，同時亦在探究少年司法工作人員、安置輔導機構工作人員對於安置輔導 執行面的需求與建議。根據研究發現，作者就安置輔導實務分別針對司法體系與 社政體系提出具體的建議。 關鍵詞：少年事件處理法、安置輔導、觸法少年 102 朝陽人文社會學刊第一卷第 1 期 The Practice in the Residential Community-Treatment of Juvenile Delinquents Li, Tzu-Chiang Probation Officer, Tai-Chung District Court ABSTRACT Legal treatment for juvenile delinquents in Taiwan is based on the Law Governing the Disposition of Juvenile Cases. In recent years, the concept of punishment has been replaced by the idea of rehabilitation in treating juvenile cases.
