Based on the characteristics of the elements in patent document ，the paper builds the relationship of the root node ，the father and son node and the leaf node of structure tree. The result of experiment shows that :applying the structure tree to the similarity computing of patent document ，the precision ，recall rate and F1 indicator are improved by 22. 31% ，14. 53% and 20. 30% respectively based on the comparison of 4 elements weighting method ;the precision ，recall rate and F1 indicator are improved
