承包商施工索赔存在的问题及对策 摘 要 索赔管理是工程项目管理的重要内容之一，而承包商施工索赔管理则是索赔管理的一个重要方面。工程项目通常具有一定的复杂性和不确定性，这种复杂性和不确定性往往会导致各种无法预料的事件的发生。此时工程索赔就变得异常重要，它是维护自身利益的重要手段。承包商为了实现经济效益最大化，就必须重视工程索赔问题，增强索赔管理。同时由于合同管理是项目管理的重要组成部分，工程索赔作为合同管理的一部分，是一项极其重要、复杂、细致的工作，它能直接影响合同执行的结果。 所以，探讨和关注承包商施工索赔管理是很有意义的。 本文从承包商的角度出发，阐述了我国工程项目施工索赔中承包商普遍存在的不敢索赔，不懂索赔，不会索赔的问题，并通过对国内外施工索赔状况的分析，引出工程索赔工作的必要性以及我国承包商当前在工程索赔方面面临的问题，进而找出出现此种情况的原因，并提出相应的意见和建议，为承包商获得和维护自身合法利益做出贡献。 关键词：工程项目 施工 承包商 索赔 The problems and countermeasures of contractor construction claims Abstract Claim management is one of the most important content of project management, and the management of the contractor of construction claim is an important aspect of the claim management. On the contractor’s point of view, the paper expounds the problem on our contractors which they dare not to claim ,don’t know how to claim and can’t claim , and through the analysis of domestic and foreign construction claim status, necessity of construction claim work and our contractors faced in construction claim problems, then find out the reasons, and puts forward the corresponding opinions and suggestions, make contribution for the contractor to obtain and maintain their own legitimate interests.
