河北经贸大学毕业论文 PAGE PAGE 4 摘要 适用法律规则处理个案是法律适用的常态，法律原则只有在极其特殊的情况下才直接适用于个案。相对于法律规则而言，法律原则作为法律规范的一种，与法律规则一样具有适用的必要性与价值，其在克服法律规则的僵硬性缺陷，补充法律规则的漏洞、解决法律规则的冲突中起着非常重要的作用，其意义还体现在指导法官审理案件、实现个案正义等方面。在一定程度上缓解规范与事实之间的缝隙，从而能够使法律更好地与社会相协调一致。但另一方面，法律原则也有其明显的缺陷：由于内涵高度抽象，外延宽泛，不像法律规则那样对假定条件，行为模式和法律后果有具体明确的规定，所以当法律原则直接作为裁判案件的标准发挥作用时，会赋予法官较大的自由裁量权，从而不能完全保证法律的确定性和可预测性。同为法律规范，法律原则的适用条件和方法却不同于法律规则。在法律实务中，为保证法律原则被援引的合法性不被质疑，援引必须遵循严格的条件和方法。此外，在发挥法律原则重要作用的同时，也要防止法律原则的滥用，只有在一定范围和界限内适用才能使法律原则的作用发挥得恰到好处，超过这个度只能适得其反。 关键词 法律原则；必要性；条件；方法；限制；范围 Abstract Applicable law rule processing of legal application case is the norm, legal principle only in very special circumstances are directly applicable to case.
