山东科技大学本科毕业论文 PAGE PAGE 2 摘要 自2008金融危机以来，国家投入4万亿资金进行基础设施建设，铁路、机场、高速公路、港口、隧道、桥梁等基础设施在中国的大地上遍地开花，与此同时，我国正在进行如火如荼的城市化运动，商品房、保障性住房、医院、学校等民用建筑在各个大中城市中破土而出，中国建筑业迎来了21世纪的春天。建筑产品的一次建成性和安全性决定了建筑是一种特殊的商品，其对人力物力的消耗也是巨大的。现阶段建筑业从业人员素质的参差不齐和监督管理不完善也是不可回避的，其必然会导致商品质量的不可保证。为保护人民生命财产安全和建筑公司的合法盈利，对建筑行业可能产生的各种风险，本文从法学视角进行分析研究。 关键词：建筑业；施工企业 ；法律风险 ；合同 ；建筑法 ABSTRACT Since the 2008 financial crisis, the country has invested 4 trillion funds to build infrastructure, railways, airports, highways, ports, tunnels, Bridges and other infrastructure in China are on the increase, and at the same time, our country is in full swing urbanization sport, civil buildings such as housing, affordable housing, hospital, school, are emerging in various cities all around China. It is a spring for the construction industry in the 21 st century. Building is one kind of special commodity products because it is built in one time and requires more safety than other goods. The architecture also consumes a lot of manpower and material resources. The quality of Construction workers is uneven and administration and supervision is not perfect is inevitable, it will result in that nobody could guarantee the quality of the building . To protect peoples life and property safety and legal profits of construction companys, this paper analyzed legal possible risks of the construction industry from the perspective of law.
