摘 摘 要 随着科技的发展和经济全球化的不断加剧，贸易自由化与环境问题越来越 受到人们的关注，一方厦，贸易的扩大促进了本国经济的发展，另‘方面，发达 国家利用贸易自由化向发展中国家转移污染同时又利用环境壁垒限制进f：l。面对 如此形势，怎样协调好贸易与环境的关系呢?可持续发展是协调贸易与环境发展 的最佳模式。从理论上，贸易自由化与以发展性、持续性、公平性、综合性、反 周期性为特征的可持续发展是相容的。从实践上，构建促进贸易与环境发展的法 律体系又是极其必要的。 论文分四个部分： 第一部分阐述了贸易自由化对环境发展的影响。指出贸易发展’j环境保护址 有相容性的，可持续发展就是贸易与环境协调发展的有效途径。 第二部分是贸易自由化与环境发展的现实冲突分析。贸易自由化引发许多环 境问题，如发达国家向发展中国家转移污染，全球环境的破坏等。十口反的，Ⅲ际 贸易中的绿色壁垒又对贸易自由化的发展产生了极大的障碍，文中对绿色啭争的 成因、特征和形式进行了详细的分析。 第三部分介绍我国目前的贸易与环境问题。系统地阐述了对外丌放对环境保 护的影响以及绿色壁垒对我国对外贸易发展的影n向。 第四部分论述了实施可持续发展战略，建立贸易与环境协调发展的法律原!111J 及框架，构建有利于贸易与环境发展的法律体系。此部分为文章的雨点和创新r，i。 本文联系我国贸易与环境实际，具有一定的现实性和实用价值。 关键词： 贸易自由化 可持续发展 环境法律体系 ABSTRACTWith ABSTRACT With tlle development of science and technology with economic globalization aggravate continuously,trade liberalization and environmental problem gets more and more the solicitude of people，on the one hand trade enlarge the development that has promoted the economy of homeland．on the other hand developed countries transfer pollution to developing country by trade liberalization at the same time restrict import by environrnentaI barrier．How do we face such situation to coordinate the relation of trade and environment?Sustainable development iS the best paaem of coordinative trading and environmentaI development．From theoretically,trade Iiberalization could be compatible with sustainable development in the ability to development，sustainability,equality,synthesise and anti—periodicity．From practice．It is extremely necessary to found the legal system that promotes trade and environment to develop． Paper divides into 4 parts： It is the first to divide to elaborate the trade 1iberalization influence for environmental development．Point out that trading development and environmental protection have consistence．sustainable development iS the effective channel of trade and environmental coordinative development． Second part iS the realistic conflict analysis of trade 1iberalization and environmental development．Trade liberalization has c
