摘 摘 要 万方数据 万方数据 摘 要 20 世纪 60 年代美国枪支管制问题，一直是研究美国问题的专家学者非常感兴 趣的论题。联邦政府介入枪支管制是在 20 世纪 30 年代，真正主要的枪支管制法， 出现在 20 世纪 60 年代。60 年代，美国枪支犯罪增多，尤其是美国总统肯尼迪、 民权运动领袖马丁·路德·金等被刺杀的恶性事件，使枪支问题凸显出来。这些 刺杀事件，成为推动美国 20 世纪 60 年代枪支管制立法的直接原因。《1968 年枪支 管制法》是 20 世纪 60 年代美国枪支管制立法的主要成果。 枪支管制问题是美国棘手的政治问题。美国是世界上少数准许公民个人持有 枪支的国家之一，这有着深刻的历史渊源和宪法渊源。私人持有枪支的传统是美 国在殖民地时期逐渐形成的，宪法第二条修正案为这一传统的神圣不可侵犯提供 了保障：“管理良好的民兵是保障自由州的安全所必须的，因此人民持有和携带武 器的权利不得侵犯。”从这个意义上讲，枪支管制与否、立法成功与否不只是涉及 减少犯罪、保护公民人身安全的立法与行政管理问题，而且是涉及对宪法第二条 修正案的理解问题，是涉及公民权利和公民自由的宪政问题。所以《1968 年枪支 管制法》通过，有深刻而复杂的政治原因。 本文以《1968 年枪支管制法》为研究对象，通过对这一立法通过的背景、过 程、结果和该法案具体内容的剖析，来阐述《1968 年枪支管制法》的在美国联邦 枪支管制历程中的巨大影响和作用，在看到《1968 年枪支管制法》的巨大影响和 作用的同时，也应看到美国联邦枪支管制立法的作用也是有限的。 关键词 美国；枪支管制；枪支文化；《1968 年枪支管制法》 I - 哈尔滨师范大学硕士学位论文 哈尔滨师范大学硕士学位论文 Abstract The gun control problem of America in the 1960s has always been the experts and scholars interested in. The federal government intervention in gun control is in the 1930s,after several important gun control acts past, the main gun control act appeared in the 1960s .In the 1960s,the assassinations of John Kennedy ,Martin Luther King, make gun control problem become outstanding. These assassinations become the direct reason of gun control legislation. The Gun Control Act of 1968 was the main achievement of American gun control legislation in the 1960s.
