摘 要 与自然人的姓名、肖像等能为他人所辨识而可作为区分特定人身份的依据一 样，自然人的声音也具备这样一种标识性功能。行为人对自然人的声音利益进行 侵害，有可能对权利人造成人格尊严上的受损及财产利益上的损失。现实生活中 声音侵权的现象剧增，由于立法上的“空白”状态，司法实践中对声音权的直接 保护往往陷入“无法可依”的尴尬境地，导致当声音利益遭到侵害，权利人难以 得到有效地救济。目前我国立法界及学界对声音权保护仍无统一定论，从对公民 的人格权进行全面保护的现实需要及人格权法的自我发展及完善等角度出发，对 声音权的民法保护作出一些有益的分析和探讨，具有其必要性和合理性。 本文拟从对声音权制度基本问题的研究出发，通过对我国声音权保护现状 的研 ，分析总结出我国声音权保护存在的现实问题，并在对域外声音权保护制 度及经验进行分析评论的基础上，为我国建构声音权民法保护制度提出合理化建 议。本文认为，将声音权纳入我国民法保护体系，从法律制度上对该项权利予以 认可和保护，势在必行。 关键词：声音利益;声音权;民法保护 I Abstract As with the nature persons’name and portrait,thenature persons’voice has the functionofthepersonalit identification.Theinfrin-gementtheinterestofthenature persons’voicewillexerthugelosstothepersonaldignit andpropert benefitsofthe rightholder.Astheincreasinginfringementofnaturepersons’therightofvoicewhich hasalawblankinitsprotection,theobligeeisalmostplacedinanawkwardsituation with no suitable legislation to protect their interest in judicial practices.Currently,the protection of the right of voice is still an open question in practical andacademiacircleinourcountry.Itisnecessit andreasonabletoresearch and discuss the civil production of the right of voice from the perspective of self-developmentandperfection oftheright ofpersonalit .Fromthepersperctive of basic problems of the right of voice , this paper analyzes and sumsup the realistic problems ofthe protection of the right of voice in currentl b studyingthe current situationonprotectingtherightofvoiceindomestic .Besides,theauthoralsotriesto provide rational suggestions for improvement of establishing civil law protection systemoftherightofvoiceinchinab referringtheexperienceandprotectingsystem of the right of voice from other countries.In this paper,the author dissertates it is imperativethatputthelegalprotectionoftherightofvoiceintoourcivillawsystem.
