Y。619358内容提要 Y。619358 内容提要 法律文化是人们关于法律现象的观念、理论、信仰以及由此而产生的行为方式的 总称。 本论文以全面建设小康社会这一时代背景下的法律文化现代化为主题。当历史揭 开新世纪序幕，市场经济体制在巾E!I初步逃立，中医f进入全面建设小康社会新的发展 阶段。小康社会应是法治社会。而法治社会的建成，不仅需要现代化的法律制度，还 更深层次地要求继续推进法律文化现代化。但由于中国传统法律文化的影响根深蒂 固，建设法治国家的任务依然艰巨。因此，研究法律文化现代化对于全面建设小康社 会具有重要理论意义和实践意义。 本论文立足于小康社会的新形势、新任务，在论述了法律文化的一般理论和中国 法律文化的发展规律的基础上，提出了小康社会法律文化现代化的目标即建设有中国 特色的社会主义法治型法律文化，实现依法治国，并进而从社会主义市场经济、政治 文明、先进文化、市民社会的建设以及中国参与全球化进程五个途径论述了如何推进 中国法律文化现代化。 本论文以历史唯物主义为指导，运用了．比较的方法、历史的方法和社会实证分析 的方法。 关键词： 小康社会 依法治国 法律文化现代化 来经作者、导师同斌 匆全文公布 AbstractLegal Abstract Legal culture refers all those of people’S notion，theories and values concerning the phenomenon of law and the corresponding modes of legal behavior． The topic of the thesis is the modernization of legal culture in building well—off society in all—round way，In the beginning of the new century,the system of socialist market economy has exrtered the prelinainary stage and China begins build，in all—round way，a well-off society which should be ruled by law．In order build such society，it needs only modern legal system but also modem legal culture．However,due the influence of deeply—rooted Chinese traditional legal culture，building nation ruled by law is still very difficult，Therefore，it is very valuable both in theoretical and practical to study the issue of the modernization of legal culture． According to the demands of the new situation and new mission of building well-off society in all--round way,and based the general theory of legal culture and the rule of developing Chinese legal culture，the thesis pinpoints the goal of the modernization of legal culture in the well—off society，namely,to build type of socialist law—ruled legal culture with Chinese characteristics and to realize ruling the country by law．Furthermore，it discusses how promote the modernization of Chinese legal culture from following aspects：Constructing socialist market economy,the political civilization，the advanced culture，the citizenry society and participating
