论对司法的监督 论对司法的监督 中文提要 论对司法的监督 中文提要 司法不公和司法腐败问题在我国已成为社会高度关注的热点问题之一，加强对司 法的监督和制约已显得十分必要．对司法的监督的制度设计目的是为了防止司法权的 溢用和司法不公，最终为了实现司法公正．然而，我国现行监督模式不符合司法的规 律和权力制约规律，监督机制表现为单向监督，而监督立法的长期缺位和监督程序的 严重缺失，又造成了现行监督的随意和无序．因此．改革现行监督体制势在必行，而 如何构建有利于实现司法公正的现代法治监督体制，则成为了当前十分紧迫的课题。 本文认为，只有在权力分工与权力制衡的基础上，遵循严格法律程序原则，才能将现 行监督体制改造成为法治所需要的现代监督体制，并为此提出了具体的改革构想，以 期对构建符合法治要求的现代监督体制，促进司法公正之实现能有所贡献。 关键词： 监督 司法公正 体制改革 作 者：林操场 指导老师：孙莉 Discussion Discussion on the Supervision on Justice Abstract The issues concerning judicial partiality and judicial corruption have atlxact(xl great attention in the society and thus b咖e one of the most heated discussion topics． Thereafter,it is imperative to intensify jusfice supervision and contr01．The aim of stipulating justice supervision system is tO prevent the misuse ofjurisdiction and judicial partiality and eventually realize the judicial impartiality．Whereas，the current supervision pattern of China doesn’t conform with the rule of justice and power constraint,and the supervision mechanism appears tO be unilateral supervision．The long term and serious absence of supervision legislation and supervision procedure has rendered the random and disorder of the nlrrent supervision．Therefore，reform of the伽arent SUl把rvision system becomes the only way ouL An urgent task is thus put OIl the agenda about how tO constnlct a modem supervision system accord吨to law to benefit the reali动矗on of judicial i如舯rtiali够It is stated in this article that the刘n哑supervision systelll c姐onty be 仃a．nsformed to衄effective modem supervision system as r踟luired by hw by strictly abidillg by the principle of law procedure On the basis of power division and restriction． And the article fIl舳proposes specific reform conceptionexpecting to make contribution to the construction of modem supervision system required by law and the promotion ofthe realization ofjudicial impartiality． Key words：Supervision,Judicial Impartiality,System Reform Written by LinCaoChang Supervised by SunLi II 苏州大学学位论文独创性声明及使用
