摘要 摘要 摘 要 目前我困在商品住宅物业管理领域矛盾频发，其中有业主和企业自身的观念和素质问 题，但更多的是在管理制度和方法等方面存在着诸多有待改善和完善的地方，因此有必要 在现有政策的框架下寻求创新思路和提出改善现状的措施建议，以更好的提升我罔物业服 务水平，引导小区实现良性发展。本文旨在通过借鉴产权理论在小区共有权益管理过程中 的应用，结合小区项目工程构建过程提出小区共有产权的界定分类，并给出小区股权计量 模型和收益分配模型，从而构建出小区共有权益公司法人制管理的模式，以实现小区资产 的经济效益。本论文首先通过比较分析国内外有关小区共有权益的法律和有关专家研究理 论，选择以产权理论、工程构建过程为契合点深入研究共有权益的确认问题以及在产权明 晰的情况下分析业主权益进行股权投资的问题，并给出了小区共有权益收益分配模型:在 上述研究的基础上，依据对小区共有权益的界定划分，重点考虑对可经营性共有部分进行 经济管理，在分析了小区构建公词管理制的必要性基础上，希望在小区可以建立功能明确、 运行高效、治理完善、监管有力的公词法人制小区权益治理模式，并给出了共有权益管理 的运行机制，深入摞讨了小区共有权益管理经营的决策、监管方法，提出了全套管理模式 的运行框架。最后，结合天津市水木天成社区实例具体管理办法、存在的问题运用构想模 式加以说明分析，并就小区现状提出了改善建议。 关键词:住宅小区;共有权益:公司法人制:管理模式 Abs Abs忧郁t Abstract At present there are frequentωntradictions in China prop町ty field，inc1uding 伽 ownerand ent町prise own idea and the quality issues，but whats more are 硝，pects for improvement in the management system and method. 80 it is necessaryωseek 岛r innovation ideas and puts forward the measures to improve the situation under the 食amework of existing policy，in order toimprove our prop町tys目vice level and 例ide 由e residentωachieve the benign development.叽le paper adapted the application of property thωry in management ofωmmon righ俑， combined with 由e construction process of residential project proposed the definition of residential prop町ty right， and giv部 community 叫uity measurement model，then drew the ∞叩orate management model to achieve the economic benefits of communityωsets. The paper first analyzed the domestic and foreign related plots studies of law and the relevant e印刷s thωry，ωidentify ∞mmon rights and mutual rights of the 叫uity inves伽ent under the ωndition of the rights of owner clarity which choose the property rights thωry and engineeringωnstru Ctìon process 伽 the thorough research，and gives the distribution mode of 叫uity income; On the basis of the s阳d弘 discussed 伽 decisionmaking and sup阳vision method ofωmmunity rights management ，proposed the framework of management mode. Finally，to illustrate the mode ωmbined with example of Tianjin ∞iffimunity.
