I I 摘 要 摘 要 目前,我国的父母支付子女抚养费的问题,对未成年子女的生活和学习带来了不利的 影响。离婚后的父母对未成年子的抚养和照顾是否适当和充分,对未成年子女的成长有重 要的影响。因此,法律应对离婚父母抚养未成年子女问题做出明确而具体的规定,来保障 离婚后未成年子女的利益,这也是本论文研究的出发点。本文首先对离婚父母抚养未成年 子女问题进行分析,并对英国、美、德国等国家相关立法进行比较研究,分析我国现有法 律制度的优势和不足,继而提出立足我国国情、完善我国离婚后父母对未成年子女抚养制 度的立法建议。本论文分为四章:第一章:子女抚养费概述。在本章中,笔者针对抚养费的 概念、抚养费的特征、健全抚养费支付的意义进行了阐述。第二章: 我国抚养费支付的 现状、问题。本章对于我国现阶段的立法评述中,笔者主要分析了我国立法的不足之处, 将抚养制度进行评述。第三章：国外关于抚养费支付的制度分析。本章对英国、德国婚 姻家庭法的相关制度进行比较研究,主要从抚养权的行使方式、直接抚养人的确定、抚养 费的支付制度进行论述。第四章:我国未成年子女抚养制度的完善。通过对我国抚养费支 付的完善建议，以期对我国的子女抚养费支付问题尽微薄之力。第五章：结束语。 关键词 子女抚养 抚养费 子女最佳利益 II II Abstract Abstract At present, China s parents to pay child support issues , for minor children living and learning has brought adverse effects.
