中 国 政 法 大 学 本 科 生 学 年 论 文 论文编号： 中国政法大学 极地的国际法问题： 西北航道的国际法律地位分析 中国政法大学 国际法学院 2011级学生：赵宇 PAGE 1 PAGE 1 PAGE PAGE 1 PAGE 1 PAGE 1 西北航道的国际法律地位分析 【摘要】 地处北极的西北航道因其日益突显的重要战略地位，使得以美国、加拿大为首的众多国家纷纷提出有利于自己的主张及要求。然而，西北航道的法律地位尚未定论，存在加拿大内水和国际海峡两种主张。并且，西北航道具有其法律特殊性，即在国际法上属于国际海峡，但其作为被《联合国海洋法公约》所承认的北极例外情形可为加拿大进行必要控制。根据地理标准及功能标准，西北航道应当被认定为国际海峡。我国应当承认西北航道的国际海峡地位，并更加积极地致力于促进国际社会参考的《斯匹次卑尔根群岛条约》模式缔结有关西北航道的条约。 【关键词】 国际海峡 过境通行制 无害通过权 西北航道 《斯匹次卑尔根群岛条约》 PAGE PAGE 1 PAGE PAGE 1 The Analysis on International Legal Status of The Northwest Passage [Abstract] With global warming and the Arctic ice cap melting, the Northwest Passage formed gradually. Because of its extremely crucial strategic significance, Canada and the U.S, as the representatives of the other countries, began to raise the legal status of the Northwest Passage in favor of their own interests. This paper first outlines the dispute of legal status of the Northwest Passage , followed by a detailed analysis of legal particularity of the Northwest Passage resulting from Canadian national legislation with the provisions of international law. Then, it demonstrates the Northwest Passage is in line with the property of International Strait. Finally, it proposes that China should actively devoted itself to signing the treaty with the international community referring to Svalbard Treaty concerning the issue of the Northwest Passage in order to deal with the future disputes.
