摘要 摘 要 在大数据背景下侵犯个人信息的案件接踵而来。鉴于侵犯个人信息的行为方式出现 多元化，所以个人信息的刑法保障更加急迫和艰难。国际社会普遍开始关注公民个人信 息安全问题，然而我国个人信息刑法保护却存在迟延性。在详细搜集和查阅有关个人信 息保护的著作以及相关的文献资料的根基上，通过分析大数据背景下个人信息保护的三 个典型案例，并结合我国大数据背景下个人信息刑法保护的现状以及司法实践，得出我 国存在的一些不足之处，侵犯个人信息罪的构成要件的缺陷，犯罪主体的范围狭窄，侵 害个人信息罪的行为方式不够全面，缺乏犯罪 “情节严重”明确的认定标准，法律保护 体系不健全，《个人信息保护法》的缺位，缺少个人信息非法收集、过度分析和泄漏的 刑法保护，个人信息刑法保护的罪名体系不健全等。提出个人信息刑法保护的完善建 议，明晰侵犯个人信息罪的构成要件，增加侵害个人信息罪的行为方式的种类，明确 “情节严重”的认定标准，建立个人信息法律保护体系，加快出台 《个人信息保护 法》，健全个人信息非法收集、过度分析、泄露的刑法保障，完善立法模式，健全侵犯 个人信息的罪名，形成侵犯个人信息的罪名群。在此基础上总结可供我国借鉴的宝贵经 验，促进我国建立完备的个人信息法律保护体系。 关键词 大数据时代；个人信息；刑法保护 I Abstract Abstract In the context of big data, cases of infringement of personal information come one after another.
