摘 要 一个国家国民经济高度发展的重要衡量指标就是其高速公路的发展状况， 而大量、稳定的资金来源对高速公路的建设尤其重要。高速公路PPP模式同时 拥有公共属性及盈利属性，满足政府方对公益性的追求和社会私人资本方对利 益的要求，可谓达到社会效益和经济效益的双赢。 美国作为发达国家，其高速公路PPP模式拥有发展早、投资多、数量大等 特点。本文搜集美国联邦、各州的高速公路PPP相关立法、指导性的政府文件 以及研究相关案例，分析研究美国对于高速公路PPP模式的法律规制是从以下 四个方面来进行的：一是从联邦层面上的立法规制；二是设立全国性PPP发展 的管理机构；三是在州层面也根据各州情况出台了相关立法文件；四是 《收费 公路PPP模式特许经营合同核心指南》对于高速公路PPP特许经营协议各方面 的规定与指导，其中又包含了协议双方权责规定、风险分担、项目监管以及纠 纷解决机制。本文对美国的两条典型PPP模式高速公路进行案例分析，探求其 中的法律规制，分析其中的经验与教训，为我国高速公路建设新模式的探索提 供有力的依据。 针对美国高速公路PPP模式法律规制的优点予以学习转化，不足之处加以 反思，得出对我国高速公路PPP模式法律规制的对策：构建完善统一的法律体 系；建立PPP项目监管机构；用法律保障风险分担机制；明晰特许经营协议履 行纠纷解决机制。 该论文有图1幅，表1个，参考文献51篇。 关键词：美国；高速公路；PPP；法律规制 I Abstract Expressway development is an important indicator to measure the countrys economic development, and a lot of stable funds help expressway construction.The PPPmode of expressway hasboth thepublic attribute andtheprofit attribute,which can meet the governments pursuit of public welfare and the social private capitals requirement of interests,and can achieve awin-win situation of social and economic benefits.
