合肥师范学院2016届本科生毕业论文（设计） 从“姚贝娜事件”谈媒体知情权与公民隐私权的冲突与平衡 合肥师范学院2016届本科生毕业论文（设计） PAGE PAGE 2 PAGE PAGE 1 摘 要 随着新闻媒体日益壮大和信息技术迅速发展，新闻侵权事件也随之增加。本文针对“姚贝娜事件”中记者在新闻采访的过程中侵犯当事者的隐私权的行为进行探究，在此次事件中，记者的缺失行为引起了我们的关注，我们在找到媒体知情权和公民隐私权平衡点的同时，应该想到，我们自身可以做什么，怎么才能真正有效地避免两者的冲突，这是我们应该思考的问题。本文通过“姚贝娜事件”中媒体人的做法延伸到对社会中新闻媒体侵犯公民隐私权、超越新闻自由的界限和有悖职业道德的行为进行反思，分析媒体知情权和公民隐私权冲突的本质，最后从相互衡量利益、媒体正确报道公众人物的隐私、尊重当事者的意愿、加强媒体的责任意识和补救意识的五个方面找到了媒体知情权和公民隐私权冲突的平衡点。 关键词：姚贝娜事件 新闻媒体 知情权 隐私权 PAGE PAGE 4 PAGE PAGE 3 Abstract With the increasing development of the news media and the rapid development of the information technology, the news tort also increases.
