专利侵权之法律责任研究 内 容 摘 要 随着专利申请数量的增长，专利侵权问题也逐渐显现，我们对专利权的保护 也应该要进一步加强。论文通过了解有关专利侵权的理论，对专利侵权行为有一 个大致的认识，从而引出法律在专利保护上存在一些不足，有必要对法律责任 行研究；其次探讨了我国的立法现状，提出了在精神损害赔偿方面存在的问题以 及加强刑法保护的必要性。在列举其他国家和地区对专利的法律保护情况，了解 了其他国家或地区与我国大陆地区在法律上对专利的保护程度不同后，通过对 比，可对我国《专利法》和《刑法》给以增加或修改，在民事责任方面完善法定 赔偿的适用条件，或者增加精神赔偿的相关立法，在刑事责任方面对假冒专利罪 进行分类，或扩大刑法对专利侵权行为的规定范围，两者相结合能进一步完善我 国对专利的相关法律保护，为解决当前专利侵权问题提供思路。 关键词：专利侵权；法律责任；赔偿 I Research on the Legal Liability of Patent Infringement Abstract With the increase in the number of patent applications, the problem of patent infringement as gradually emerged, and our protection of patent rights should be further strengthened. Through understanding the theory of patent infringement, the paper has a general understanding of patent infringement, which leads to the law in the patent protection of some deficiencies, it is necessary to study the legal liability; Secondly, it discusses the present situation of legislation in our country, puts forward the problems in the aspect of compensation for mental damage and the necessity of strengthening the protection of criminal law. In other countries and regions listed on the patent legal protection, learned about other countries or regions and in mainland China at different levels in the law on the protection of patent, by contrast, can be the patent law and criminal law of our country to increase or modify, perfect legal compensation applied conditions in respect of civil liability, or increase the mental compensation legislation, classify face counterfeit patent crime in the criminal responsibility, or expand the scope of the provisions of the criminal law for patent infringement, combined the two can further consummates our country related legal protection of patents, to solve the problem of the current patent infringement.
