Therefore, the legal elements of the offense and its criminal facts, determination, and punishment have always been concerned. Based on the main perspective of protecting legal rights, this article conducts research and analysis on relevant legal provisions and practical issues of the crime, and draws the following conclusions: 1. The offense of illegal entry into a residence includes two different situations, illegal entry into a residence and illegal residence in a residence; 2. The specific criminal facts should be determined based on the specific circumstances of the case, and should not be overly rigidly based on factors such as the criminal object, method of crime, etc.; 3. Punishment should be judged based on the nature, circumstances, and harm of the crime, severely punishing acts that damage others rights, and paying attention to correction and education; 4.
