DIRECTIVE 2009/48/EC OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 18 June 2009 on the safety of toys (Text with EEA relevance) THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION, Having regard to the Treaty establishing the European Community, and in particular Article 95 thereof, Having regard to the proposal from the Commission, 1 Having regard to the opinion of the European Economic and Social Committee ( ), 2 Acting in accordance with the procedure laid down in Article 251 of the Treaty ( ), Whereas: (1) Council Directive 88/378/EEC of 3 May 1988 on the approximation of the laws of the Member States 3 concerning the safety of toys ( ) was adopted in the context of establishing the internal market in order to harmonise the safety levels of toys throughout the Member States and to remove obstacles to trade in toys between Member States. (2) Directive 88/378/EEC is based on the New Approach principles, as set out in the Council Resolution of 7 4 May 1985 on a new approach to technical harmonisation and standards ( ). Thus, it sets out only the essential safety requirements with regard to toys, including the particular safety requirements regarding physical and mechanical properties, flammability, chemical properties, electrical properties, hygiene and radioactivity.
