“支付宝”网上第三方支付平台的法律问题

内容摘要

随着网络技术的进步和市场经济的快速发展，网上商品交易因为其商品信息量庞大、不受时间限制、交易方式快捷等优势逐渐被越来越多的消费者所接受。第三方网上支付平台的出现不但使消费者网上购物更为快捷还为消费者提供了安全保障。可是由于我国相关法律制度的不健全以及监管的缺失我国第三方网上支付平台的法律性质以及法律责任的承担都存在很大争议。

因为支付宝是我国第三方网络支付平台中最具影响力最具代表性的支付平台，所以本文以支付宝为例通过对支付宝法律性质和法律责任的分析来反映第三方支付平台存在的一系列问题。

本文主要以案例为出发点通过案例来发现问题。通过案例首先分析支付宝的法律性质，其次指出当前支付宝存在的沉淀资金、交易欺诈以及账户安全这三大问题，并通过这三大问题去讨论支付宝法律责任的承担。最后为解决支付宝存在的一系列法律问题提出几点自己的建议。

Abstract

Withtherapiddevelopmentofnetworktechnologyandtheprogressofthemarketeconomy,commoditytradingonlinebecauseofthehugeamountofinformationgoods,notimelimit,tradingandotheradvantagesofgraduallyacceptedbymoreandmoreconsumers.Thirdpartyonlinepaymentplatformnotonlymakestheconsumeronlineshoppingmoreconvenientforconsumerstoprovidesecurity.However,duetoChinasrelevantlegalsystemisnotperfect,thelackofregulationofthirdpartyInternetpaymentinChina,thelegalnatureandlegalliabilityoftheplatformthereisabigcontroversy.

BecausePayPalisourcountrythirdpartyonlinepaymentplatform,themostinfluentialrepresentativeoftheenterprise,sothispapertoAlipayasanexamplethroughtheanalysisofthelegalnatureandlegalresponsibilitytopaytreasuretoreflectthethirdpartypaymentplatformhasaseriesofproblems.

Inthispaperthecaseasthestartingpointthroughthecasetofindtheproblems.Throughthecaseanalysisofthelegalnatureofthepaymentoftreasure,thenpointedoutthatthecurrentexistenceofprecipitationfunds,PayPalfraudandaccountsecurityofthesethreeproblems,andthroughthethreemajorissuestodiscusspaytreasurelegalliability.Putforwardsomesuggestionsattheendofaseriesoflegalproblemstosolvealipay.
