论国际法中的庇护制度

[摘要]庇护是国际法上一项重要制度。庇护权是国家权利。庇护的对象包括政治犯和政治难民。我国宪法第32条第2款虽然规定了庇护制度，但内容过于原则，而且也没有针对难民问题的专门立法，缺乏庇护审查程序、难民待遇和寻求庇护者的待遇的规定，应结合相关国际公约完善我国庇护制度。
