从人大职权的视角分析新时期的地方人大工作 百有免费在线资料库（） 收集 【内容提要】一般认为人大及其常委会的职权包括“立法权、监督权、重大事项决定权和人事任免权”四权。人大及其常委会的职权为“立法权、监督权、议事权”三权。在新的历史时期。人大及其常委会要依法履行职能，为改革决策的科学性、民主性而努力，要通过健全议事职能的制度建设保障人民的知情权、参与权、表达权，提高议事能力与水平，同时要发挥地方人大及其常委会在依法治国中的地位，在其立法空间内履行好立法职能。并把监督职能发展为地方人大及其常委会一种经常性的工作形式，使地方人大及其常委会工作规范化、制度化、程序化，从而在逻辑上与事实上“建立健全决策权、执行权、监督权既相互制约又相互协调的权力结构和运行机制。” 　　【关键词】人大职权 地方人大工作 常委会 　　[Abstract]Generally speaking，NPC and the Standing Committee have four rights of“legislative power，supervisory power，discretionary power，and personnel patronage power”，while this thesis is of the opinion that NPC and the Standing Committee have three rights of“legislative power，supervisory power，and procedure right”．Through research on the NPC’s rights，this thesis holds the view that in new historical stage NPC and the Standing Committee shall lawfully perform their functions，make great efforts to fulfill the scientificalness and democracy of reform decisions．guarantee the people’s right to know，right to participate in and fight to express by completing the system construction of procedure function，improve the procedure ability and level，also display the local NPC and the Standing Committee’s position in course of ruling the country by law，well exercise the legislative functions in the governing scope，and thus develop the supervision function as fl regular work form，in an effort to bring the work of local NPC and the Standing Committee up to standardization，systemization and routinization，and further“set up and perfect the power structure and operational mechanism with interacting and coordinating decision—making power，executive power and supervisory power”logically and actually． 　　[Key words]NPC’s rights；local NPC’s work：the Standing Committee 　　划分人大职权的关系对新时期人大工作具有重要的意义。准确界定人大及其常委会究竟有哪些职权要有科学的原则与标准：要在我国法律体系中把握人大及其常委会的职权；要符合人大及其常委会建设的实际；要在我国政治体制框架内界定人大及其常委会的职权，符合政党政治的一般规律；能够切实对我国的民主法治建设发挥实际作用。一般认为人大及其常委会有立法权、监督权、重大事项决定权和人事任免权，而笔者认为，人大及其常委会的立法权、监督权、重大事项决定权和人事任免权四种权力的说法并不准确，而应当是不可分割的立法权、监督权、议事权三权。其中立法权与监督权是实体性权力；
