张羽：论共同犯罪 辽宁工程技术大学毕业论文 中文题目: 论共同犯罪中止 外文题目: THE DISCONTINUANCE OF JOINT COMMISSION 毕业论文共24页（其中：外文文献及译文1页） 完成日期2012年11月 答辩日期2012年12月 PAGE II PAGE I 摘要 共同犯罪是相对于单独犯罪的一种特殊犯罪形态。而对于在共同犯罪案件中，如何认定犯罪中止，学术界和司法实践中都存在着不同的观点或做法。本文首先列举了学术界关于共同犯罪中止认定的观点，然后根据刑法原则和有关共同犯罪的理论分析了我国刑法典对于共同犯罪规定的不足。作者通过对本题目相关资料的收集和相关理论问题的研究，详细分析了共同犯罪中止在我国立法和司法上的发展及现状，主张在共同犯罪中止中可以引入“脱离共犯关系”的理论，以符合刑法的罪责刑相适应的原则和犯罪中止的立法精神，通过借鉴“脱离共犯关系”概念，可以将共同犯罪中的犯罪中止予以新的认定，最后就共同犯罪理论的完善提出了自己的看法。 关键词：共同犯罪；司法认定；犯罪中止；脱离共犯关系 ABSTRACT Common crime is a special form of crime. And in the common crime, how to determine the desistance of crime, academic circles and judicial practice have different views or practice. This paper lists the academia about joint crime cognizance opinion at first, then according to the principles of criminal law and the theory about the common crime do analysis of Chinas criminal law which has the lack of provisions of common crime. The author analyzes the discontinuation of a common crime in Chinas legislative and judicial development and current situation through to the issues related to data collection and related theoretical research, advocate in the crime determination of joint crime can be introduced into the theory of separate the relationship of joint crimes , to conform to the principle of the orientation of the guilt, the responsibility and the punishment and the spirit of the legislation of discontinuance of crime, through drawing lessons from the concept of separate the relationship of joint crimes , it can make a new definition of discontinuance of crime in the common crime , finally put forward my own views on the common crime theory.
