摘 要 中国建筑市场逐步与国际接轨，施工索赔在中国的缘起，是建筑业市场化的产物，是与国际接轨的产物。然而目前市场化程度不够，施工索赔还不是建筑行业的通行做法。由于我国经济体制及一些其他因素的阻碍，导致在施工索赔过程中还存在着很多的问题，严重制约了我国建筑业发展，减缓了进入国际市场的，如何完善我国施工索赔是建筑企业的重要课题。 本文通过分析我国工程索赔意识薄弱的主客观表现，探究造成我国索赔管理落后现状的主客观根源进而提出提高我国索赔管理水平，改善我国索赔现状的具体措施关键词：索赔现状；索赔程序；索赔方法 Abstract Chinas construction market gradually integrating with the international community, the origin of the construction claims in China is the product of construction market. It is also the product of international standards. Now, however, the degree of marketization is not very ripen, the construction claims are not building industry’s current practice .Because of the hinder of Chinas economic system and some other factors, the process of construction claims also has very many problems, which seriously restrict the development of construction industry, slowing down the pace of entering the international market, how to perfect our countrys construction of the construction enterprises of the claim was an important subject. Through analysis of the construction claims situation at home and abroad, pointing out that the weak awareness of the engineering claims of subjective and objective performance, exploring the claim management of the present situation of the subjective and objective root source, and combining the basic theory and method of claim in the engineering claim, and adding a certain amount of case analysis, from the quantitative and qualitative research on two aspects, putting forward the specific measures for China to enhance the imanagement level of all parties and improving the current situation of the claim.
