 本科生专业文献综述 题 目: 关于行政强制中利益衡量的综述 姓 名: 陈 静 学 院: 人文社会科学学院 专 业: 法 学 班 级: 42 班 学 号: 2 2 6 4 2 2 0 指导教师: 杨 钦 职称: 助 教 2007 年 06 月 29日 南京农业大学教务处制 关于行政强制中利益衡量的综述 法学专业学生 陈静 指导教师 杨钦 摘要：行政强制制度是保证行政机关顺利履行法定职责、维护社会经济秩序、保护公共利益和私人利益的十分重要的法律制度。该制度在我国虽已初步建立，但由于没有统一的法典，因此依然存在着诸多问题。这些问题主要反映在利益平衡方面，行政强制制度中的公共利益与私人利益之间经常呈现失衡的状态，一旦这种状态得不到及时的调整与修正，就会加深行政机关与行政相对人之间的对立，进而破坏社会的和谐。因此，只有平衡并维护各方合法利益，行政强制中存在的问题才可能在根本上得到解决。有鉴于此，本文拟通过介绍国外一些主要国家和地区的行政强制制度，结合我国行政强制制度的现状，通过分析借鉴以弥补我国之不足，以期对完善我国行政强制制度有所帮助。 关键词：行政强制；公共利益；私人利益；利益平衡 Interest Balance in Administrative Compulsion Student majoring in Law Chen Jing Tutor Yang Qin Abstract：Administrative compulsion is a quite important system by which the administration departments can perform their duty in law successfully, make the society and economy in order and protect the public and private interest. However, it is not a perfect system in China. Because our country has no uniform corpus juris, Therefore, there are so many problems in the course of implementation especially in balance of interest. It is shown that the pubic interest and the private interest is often unbalance in administrative compulsion. If the unbalance estate can not be adjusted and modified, the opposition between government and private part would be worse even destroy social harmonization. Therefore, only balance and maintain interest, the problems of administrative compulsion can be saved radically. So, this article introduce some foreign coercion system’s status, via analyzing and extract, in order to make up our deficiency, wish to help to impruve our administrative coercion system.
