河南广播电视大学 毕业论文 论文题目：浅论抵押权效力范围 班级专业：2003春法律 姓 名：刘 鹏 学 号： 指导教师： 浅论抵押权效力范围 内容摘要：抵押制度源远流长,起源于古希腊,古罗马时代就已经比较发达了。我国抵押制度也有着悠久的历史。在隋唐时代，抵押制度已经被法律所认可。在各种担保当中,抵押是一种比较理想的担保方式。抵押的设置既增加了所担保的债权的安全性，又在不排除抵押人对抵押物的正常使用、收益的情况下为抵押人融通了资金，提高了社会资源的利用率，被称为“担保之王”，为人们所广泛采用。抵押制度对我国的社会主义市场经济的建立与发展起到了有力的促进作用。但是，我国的抵押法律制度的建立却比较晚，且不完善，尤其是在抵押权效力范围方面，法律规定不够明确，在司法实践中，可操作性不强。本文从抵押概念和属性着手，通过对同抵押相关联的从物，附合物、混合物和加工物，孳息，从权利，分离物和代位物的法律性质的分析，就抵押权的效力范围的界定问题提出个人的一些看法，以望能够对我国正在制定的物权法的制定贡献一点微薄之力。 关键词：抵押 抵押权 抵押权的效力 Abstract: Mortgage system of long standing and well established, originate from ancient Greece, ancient Rome era on already more developed. The system of mortgage of our country has long history too. In Sui and Tang dynasties, the system of the mortgage had already approved of by the law. In various kinds of guarantees, the mortgage is a kind of more ideal guarantee way. The establishment of the mortgage has increased the security of the creditors rights assured , and is not getting rid of mortgagors normal use to the mortgage , have circulated necessary funds for the mortgagor under the situation of the income, it also have improved the utilization ratio of social resources, so it be known as the king assuring it ,and is adopted extensively by people. The system of the mortgage plays a strong role to the setting-up and development of the socialist market economy of our country. However, the setting-up of the legal system of mortgage of our country is later, and not perfect, especially in scope of validity of hypothec, the legal provisions are not clear enough, in the judicial practice, an effectiveness is not strong. This text sets about from the concept of the mortgage and attribute , adopt right and the mortgage is related from the thing , conform to the thing , mixture and processing things , the fruits, from the right , separate the analysis of things and legal nature of taking the place of the location thing , put forward some personal views on identification of the scope of validity
