Abstract
WithChinasentryintotheWTO,thecustomsofChinashouldfaithfullyperformthe
dutyofprotectingintellectualpropertyrightunderTRIPS.Itsimportanttoinvestigatethe
statusquooftheirrealperformanceandtofindproblems,especiallytheinadequacyin
enforcingtheTRIPSurles,soastomakepossibleimprovementsonthatbasis.
Citingdifferenttheoriesandcases,thisthesisanalyzesthepresentsituationofborder
protectionofintellectualpropertyrightbyChinesecustomsincomparisonwiththosein
theU.SandtheEU.Italsodiscussesthedeficienciesinlawsandspecificregulations
concerningborderprotectionofintellectualpropertyrightinChina,whichisinconsistent
withTRIPS,andputsforwardsuggestionsandcountermeasuresasfollows:
(1)Toremovetheproactiveborderprotectionrightofthecustomsonpatent
protection;
(2)Toprescribethatborderprotectioncannotbeappliedtoparallelimports;
(3)Toannulthepowerofthecustomsoninvestigatingandaffirminginrfingement;
(4)Tograntthecustomsdetentgoodswhenthecustomshasacquiredprima
facieevidencethatanunrecordedtrademarkorcopyrightisbeinginrfinged;
(5)Toacceptmorekindsofassurancebesidescashinordertomitigatethe
economicpressureofIPRowners,andtoprescribethatonlythegoodssuspectedof
infringingacertainpatentcanbereleasedwithreverse-assurance;
(6)Tograntanti-smugglingpolicethecriminalenforcementpowertointerferein
seriousinfringementsacrossborders;
(7)TopreventIPRownerstomakeprofitsrfombordercontrolsofintellectual
propertybycolludingwithinrfingers;
(8)Togiveconsignersandconsingees,whoviolatedcustomsregulations,different
penaltiesaccordingtotheirsubjectiveintentions.

其具有两个含义:(1)知识产权是设定在智力成果上的权利;(2)知识产权是排他
