论继承中债权人利益的保护 法学专业学生：刘勇 指导老师：贺军 摘 要：在遗产继承过程中，由于继承法制定时特殊的时代背景和继承法理论研究的不成熟以及亲属内倾保护严重而社会干预乏力等原因，使得债权人利益的实现很难得到保障，其利益受侵害的形式主要有被继承人生前侵权、继承人及其他继承法律关系主体普通侵权、继承人或受遗赠人规避侵权三种。本文主要从完善有限责任继承和放弃继承制度以及完善遗产管理制度三个方面进行探讨。 关键词：遗产；继承；债权人利益；法律保护 Abtract: Because the special time background when the Inheritance Law was constituted,the immature research on the succession law and the absence of social interfering for relative’s execeeding protection ,it is difficult to realize the creditors’ interests.The forms which invade the creditors’ interests mainly concluded the infringement wh
