摘 要 轻缓化是刑罚进化的世界潮流，也是刑法现代化的核心内容。特别是最近200 年 来，世界各国刑罚轻缓化的进程大大加快。虽然各国由于在社会制度、经济发展水平、 历史文化传统等方面有诸多差别，因而在刑法制度方面也会有各自特点，但是人类的 刑法制度的共同性在不断增加，因此今后各国的刑法制度将呈现一种多样性基础上的 统一性。不仅全球经济一体化必将直接或间接地促进各国刑法制度互相影响并互相趋 同，而且国与国之间的文化交流日益密切，也将会促进人类在对犯罪、刑罚的理性认 识和对人道和人权的价值的尊重方面，逐渐形成大致共识，从而促进各国刑法的趋同。 本文通过对轻刑化相关内容的介绍，在分析我国重刑传统及其弊害的基础上，根据我 国当前社会发展的现状，论证了轻刑化对构建我国和谐社会的重要意义，并提出了在 构建和谐社会过程中实行轻刑化的具体方案，以期引起学界对轻刑化问题的关注和探 讨。 本文共分五章，第一章通过介绍我国的重刑传统及其现实表现，分析了重刑主义 对和谐社会的弊害；第二章介绍了轻刑化的内涵、轻刑化的理论与实践以及我国学者 对刑罚轻缓化观点的评述；第三章从我国社会发展现状等方面说明我国实行轻刑化的 价值和根据；第四章通过分析轻刑化与和谐社会的关系，说明轻刑化对构建和谐社会 的意义；第五章提出了实现轻刑化的具体路径。 关键词：轻刑化；和谐社会；构建 I Abstract Alleviation is the penalty evolution trends in the world, and is also the core content of the criminal law modernization. Especially in the last 200 years, the penalty-alleviation course of the various countries greatly speeds up. Because of the many differences in social system, economic development level, historical and cultural traditions etc. in various countries, they have respective characteristic in criminal law system, but the intercommunity of humanitys criminal law system will be increasing unceasingly, therefore, the criminal law system of various countries will present one kind of unity on the basis of multiptulity. Not only the global economic integration will directly or indirectly promote the mutual impact and the mutual convergence of the criminal law system, but also the cultural exchanges between the two countries have become closer, which will promote the humanity to manage rough consensus on the rational knowledge of the crime and penalty, and the respect to the humanity and the human rights value.
